Terms of service.

When signing up to our fitness classes you are entering into an agreement between ACT Bootcamp ("The Bootcamp," "we," "our") and the individual who is signing up for membership ("Participant," "you," "your"). By signing up for the bootcamp membership or class, you acknowledge and agree to the following terms and conditions.

1. Membership Terms

1.1 Membership Period: The membership begins on the date of registration and will continue as per the selected membership term.
1.2 Payment: You agree to pay the fees associated with your membership as outlined during the registration process. Fees are due in advance of services rendered and are non-refundable unless otherwise stated.
1.3 Late Payments: If payment is not made on time, access to the Bootcamp will be suspended until payment is received.
1.4 Automatic Renewal: Memberships may be set to automatically renew at the end of each term. You may opt-out of the auto-renewal by providing written notice at least 14 days prior to the renewal date.

2. Health and Safety

2.1 Health Assessment: You agree to provide accurate health information upon registration. You are encouraged to consult with a physician before starting any exercise program.
2.2 Fitness Requirements: You acknowledge that bootcamp classes may involve strenuous physical activity and that you participate at your own risk. If at any time during the program you feel discomfort, pain, or injury, you agree to stop immediately and notify an instructor.
2.3 Age Requirements: You must be at least 12 years of age to participate. Any exceptions must be agreed upon in writing by the Trainer.

3. Liability Waiver

3.1 Assumption of Risk: By accepting this agreement, you voluntarily assume all risks associated with your participation in The Bootcamp activities, including, but not limited to, physical injury, accidents, or other health risks.
3.2 Release of Liability: You agree to release, indemnify, and hold harmless The Bootcamp, its employees, instructors, contractors, and agents from any liability for injury, loss, or damage to personal property that may occur during the course of participation.
3.3 Medical Emergencies: In the event of a medical emergency, The Bootcamp will contact emergency services, but you are responsible for any medical costs incurred.

4. Code of Conduct

4.1 Behavior Expectations: You agree to conduct yourself in a respectful and courteous manner toward fellow participants, instructors, and staff. Inappropriate behavior may result in suspension or termination of membership without refund.
4.2 Alcohol and Drugs: The consumption of alcohol or drugs on The Bootcamp premises is strictly prohibited.

5. Class Schedule and Cancellations

5.1 Class Schedule: The Bootcamp will provide a schedule of classes, but reserves the right to modify, reschedule, or cancel classes as needed.
5.2 Cancellations: You must notify The Bootcamp at least 24 hours in advance to cancel your participation in any scheduled class to avoid penalty fees.

6. Privacy and Data

6.1 Personal Data: By aceepting this Agreement, you consent to The Bootcamp collecting, storing, and using your personal data (including health information) in accordance with applicable privacy laws.
6.2 Marketing: You consent to The Bootcamp using your name, likeness, and feedback for promotional purposes, unless otherwise stated.

7. Amendments to Agreement

7.1 Changes to Terms: The Bootcamp reserves the right to amend or modify this Agreement at any time. Any changes will be communicated in writing, and continued participation will constitute acceptance of those changes.

8. Termination of Membership

8.1 Termination by You: You may terminate your membership by providing written notice to The Bootcamp allowing up to 4 weeks for cancellation of membership to occur. Depending on your membership plan, cancellation fees may apply.
8.2 Termination by The Bootcamp: The Bootcamp reserves the right to terminate your membership for breach of this Agreement, including failure to adhere to the code of conduct, non-payment, or other violations.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Australian Capital Territory, without regard to its conflict of laws principles.
